Legal Nuance of Prop 207
The law was pretty well written but there is one bit of ambiguity in the stated amount that we are allowed to possess.
Not everyone is going to grow and some will buy from dispensaries or may get a bag gifted from a friend. The law states that you can possess an ounce but it’s not clear on WHERE. The “inference” is that this would be on your person when not at home, like driving FROM the dispensary after your purchase–but the law doesn’t explicitly SAY that. The statutory provision Prop 207 is found in Arizona Revised Statutes (A.R.S.) Title 36, Chapter 28.2. This voter initiative allows adults over the age of 21 to possess, purchase, transport, or process 1 ounce or less of marijuana or 5 grams or less of marijuana concentrate.
The law also states that you may possess all the marijuana that your plants grow. Section 36-2582 of the Prop 207 bill section 2 page 4 0f 17 states that. Lets face it, for 2 people in a household 12 plants with a yield of a 1/4 lb on each means you could be in possession of 3 lbs of weed–waaaay more than the ounce mentioned elsewhere.
Mark my words–there will be a “test case” on this.
